1. Agreement to Terms

Welcome to Maskani ("Platform", "Service", "we", "us", or "our"). By accessing or using maskani.libertygulf.com, you agree to be bound by these Terms of Service and all applicable laws and regulations of the Kingdom of Bahrain, including but not limited to:

• Personal Data Protection Law (Law No. 30 of 2018)
• Property Rent Law (Law No. 27 of 2014)
• Civil Code of the Kingdom of Bahrain
• Electronic Transactions Law (Law No. 28 of 2002)

2. Platform Description

Maskani is an online marketplace connecting landlords and tenants in the Kingdom of Bahrain. We provide:

• Property listing services for landlords
• Property search and viewing request services for tenants
• Communication facilitation between parties
• Property management tools

Important: Maskani is a facilitator only. We do not own, manage, or control any properties listed. All rental agreements are between landlords and tenants directly.

3. User Accounts

3.1 Registration

You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Types

• Landlord Accounts: For property owners or authorized property managers
• Tenant Accounts: For individuals seeking rental properties

3.3 Prohibited Uses

• Providing false or misleading information
• Impersonating another person or entity
• Using the platform for illegal purposes
• Posting fraudulent listings or scams
• Harassment or abusive behavior toward other users
• Automated scraping or data collection

4. Landlord Obligations

4.1 Property Listings

Landlords must ensure that:

• All property information is accurate and up-to-date
• They have legal ownership or authority to list the property
• Properties comply with all applicable building and safety regulations
• Rental prices are clearly stated in Bahraini Dinars (BHD)
• Photos accurately represent the property

4.2 Legal Compliance

Landlords must comply with the Property Rent Law (Law No. 27 of 2014) including:

• Registration of rental agreements with relevant authorities
• Adherence to maximum annual rent increase limits (as regulated)
• Proper notice periods for termination or renewal
• Maintenance of properties to habitable standards

5. Tenant Obligations

Tenants must:

• Provide accurate information in viewing requests
• Respect property viewing appointments
• Negotiate rental terms directly with landlords in good faith
• Comply with all applicable laws and regulations
• Not use false pretenses to gain property access

6. Fees and Payment

6.1 Platform Fees

Currently, Maskani offers free basic listing and search services. We reserve the right to introduce fees for premium features with 30 days' notice.

6.2 Rental Payments

All rental payments, deposits, and fees are arranged directly between landlords and tenants. Maskani does not process rental payments.

7. Intellectual Property

All content on the Maskani platform, including but not limited to text, graphics, logos, icons, images, and software, is the property of Liberty Gulf or its content suppliers and is protected by Bahraini and international copyright laws.

Users retain ownership of content they upload but grant Maskani a non-exclusive, worldwide license to use, display, and distribute such content for platform operation purposes.

8. Disclaimers and Limitations of Liability

8.1 No Warranty

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE:

• The accuracy, completeness, or reliability of listings
• The conduct or identity of users
• The suitability of any property
• Uninterrupted or error-free service

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY BAHRAINI LAW, MASKANI SHALL NOT BE LIABLE FOR:

• Disputes between landlords and tenants
• Property condition issues or misrepresentations
• Financial losses from rental agreements
• Indirect, incidental, or consequential damages
• Actions or omissions of users

9. Indemnification

You agree to indemnify, defend, and hold harmless Maskani, Liberty Gulf, and our affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from:

• Your use of the platform
• Your violation of these Terms
• Your violation of any rights of another party
• Your rental agreements or property transactions

10. Termination

We reserve the right to suspend or terminate your account at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• Harm to the platform or other users
• Non-payment of fees (if applicable)

Upon termination, your right to use the platform ceases immediately.

11. Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Bahrain.

11.2 Jurisdiction

Any disputes arising from these Terms or use of the platform shall be subject to the exclusive jurisdiction of the courts of the Kingdom of Bahrain.

11.3 Informal Resolution

We encourage users to contact us first at support@libertygulf.com to resolve any disputes informally before pursuing legal action.

12. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes via email or prominent notice on the platform at least 30 days before the changes take effect.

Continued use of the platform after changes constitutes acceptance of the updated Terms.
